Terms of Payment & Late Fees: All invoices issued by Fitness Factory KC (located in Overland Park, KS) are strictly due upon receipt or on your designated automated recurring billing date. Payments processed for gym memberships, personal training, day passes, guest passes, or access key credentials are non-refundable and non-transferable under any circumstances once billed. Unpaid invoices, declined payment attempts, or returned funds may result in immediate temporary suspension or permanent revocation of your 24-hour facility access privileges. Outstanding balances are subject to administrative late fees, returned payment processing charges, and external collection costs (including reasonable legal expenses) to the maximum extent allowed under Kansas law.
24-Hour Unstaffed Facility Access & Assumption of Risk: Fitness Factory KC operates as a 24-hour physical fitness facility and is unstaffed during off-peak hours. Members, guests, and visitors enter, utilize equipment, and exercise entirely at their own risk. You explicitly acknowledge and agree that no staff, management, safety monitors, or certified medical personnel are guaranteed to be present on-premises at any given time. By paying this invoice, you represent that you are physically capable of utilizing strength training, cardiovascular, and general gym equipment without supervision. 24-hour access credentials, keycards, and mobile app barcodes are issued solely to the individual designated on this account and remain strictly non-transferable. Unpermitted tailgating, opening locked doors for non-members, sharing access credentials, or bringing unauthorized guests into the facility during or outside of peak hours will result in immediate cancellation of access without refund, alongside a mandatory breach fee billed directly to your account.
Limitation of Liability & Indemnification: To the fullest extent permitted by the laws of the State of Kansas, Fitness Factory KC, along with its owners, directors, operators, staff, contractors, and affiliates, shall not be held liable for any personal injury, bodily harm, property damage, loss of personal items, theft, or medical emergencies occurring inside the gym premises, restrooms, common areas, or surrounding parking areas. You assume full responsibility for your physical safety and personal property. By remitting payment, you agree to release, indemnify, defend, and hold harmless Fitness Factory KC against any and all legal claims, liability, damages, liabilities, or financial losses arising out of or relating to your use of the facility or equipment.
Integration with Master Agreement: All goods, services, personal training programs, and 24-hour access provided pursuant to this invoice remain fully governed by your executed Membership Agreement, Waiver of Liability, and posted Fitness Factory KC Rules & Regulations. Fitness Factory KC expressly reserves all statutory and common-law remedies to enforce compliance, update policy terms, and recover delinquent accounts.
